TERMS OF USE OF THE WEBSITE

This document (together with the other documents mentioned here) sets out the general conditions for using the Website: https://niniabeauty.rs (from now on: the WebsiteWebsite) and purchasing products.

Before using the Website, please read these Terms of Use of the Website carefully (from now on, referred to as the “Terms of Use”). By using the Website, it is considered that the User is familiar with these Terms of Use and accepts them.

NINIA may change the content of these Terms of Use, product range, product prices, and other information related to the Website which is why users are obliged to review the Website’sWebsite’s content during each visit carefully. When using the Website or ordering products through the Website, you are bound by these Terms of Use. If you disagree with the Terms of Use and the purpose and manner of processing your data, please do not use the website website. NINA does not take responsibility for the damage suffered by the User due to: failure to read the Terms of Use; inability to purchase through the Website for justified reasons; inability to use the web site website due to maintenance, security, or any other technical sense, as well as due to denial of access to the web site website due to unauthorized use.

Use of the Website

We will process the data (including your data) provided to us by the Terms of Use, the Notice on the processing of personal data, and the Notice on cookies. When you use the Website, you consent to process your data by the above documents.

By using the Website and ordering products through the Website, you agree to:

  • use the Website only for searches and legally valid orders;
  • you will not place fake or deceptive orders;
  • The stated email address, address, and other contact information you provide are accurate, correct, and complete.

By ordering products through the Website, you agree that NINIA uses your data and contacts you to execute your order, if necessary, by the Notice on the processing of personal data. If you do not provide all the information we need, you will not be able to purchase the product. In addition, when you order products through the Website, you confirm that you are capable of concluding binding contracts.

Purchase of products

The presentation of the product on the Website is an offer to conclude a contract for the sale of products. You enter into a sales contract with NINIA as the seller. By completing a sales contract with Fush, you have all the rights provided by applicable laws. By ordering products through the Website, the User undertakes to make a payment to NINIA.

By clicking the “sign up” or “create order” button in the last step of the ordering process, you have issued a binding purchase order and committed to making a payment. After the above, the purchase order will be created as soon as possible, and you will be immediately sent an email containing all the elements of your purchase order.

Ordering

You can only order products via the Website electronically, which means that the possibility of ordering by phone or letter is excluded. Therefore, you must first select the products you want to order on the Website. Next, fill in the required fields related to your name and surname and your email address, after which you need to select the area “Login” or “Create order.” By choosing the specified field, you will receive a notification on the Website that your application has been successfully submitted.

The next step is to receive a follow-up email from NINIA instructing you to pay for and receive your product.

Ordering through the Website is easy; even if you make a mistake, we are ready to help you in any situation.

After completing the order (as described in detail in the previous section), you will receive an email notification containing all the information about the order. However, if the delivery of the ordered goods is not possible for some reason, NINIA is obliged to inform you without delay.

Product price and shipping costs

The product’s purchase price is indicated on the Website after each product, including PDV.

The product’s purchase price is expressed in RSD and will be charged in the currency of the country from which the payment is made in the equivalent of the system through which you make the payment.

The product’s purchase price does not include the delivery price, bearing in mind that the product is delivered digitally.

Method of payment

Upon delivery, you pay for the products you ordered and want to buy through the Website to the courier service. Then, you pay for the shipment exclusively to the cash courier who delivers the load to you.

The right to withdraw from a distance contract

By the law, you have the right to withdraw from the contract of sale of goods through the Website without stating the reason for withdrawal within 14 days from the day when the goods were delivered to you or a third party designated as the recipient.

Suppose you want to withdraw from the contract to sell goods, which is concluded through the Website. In that case, you can do so electronically by filling out and sending a statement of withdrawal from the contract concluded at a distance (from now on: withdrawal form). Also, you can cancel the sales contract in another specific way.

IThe statement of withdrawal has legal effect from the day it is sent to NINIA and is considered timely if it is sent within 14 days from the day the goods are delivered to you or the third party you have designated as the recipient.

If you withdraw from the contract, you bear the costs of returning the goods, and you are obliged to return the purchased goods to NINIA within 14 days from the day of withdrawal from the contract.

NINIA is obliged to refund the payments received for the goods without delay and no later than 14 days from the day when it received the withdrawal form, provided that it may postpone the refund until it receives the returned goods or until do not receive proof that you have sent the goods depending on what comes first.

By purchasing goods through the Website, you give your explicit consent for the refund to be made to your current account.

Notification on the manner and place of receipt of complaints and the way of handling complaints received

We want to inform you that you can file complaints about goods purchased through the Website electronically to the email address:
info@niniabeauty.rs. When filing a complaint, you are obliged to submit the goods to which the complaint relates, the request for a complaint, and an invoice for inspection or other proof of purchase of goods (copy of the invoice, slip, etc.).

Upon receipt of the complaint, we will issue you a written confirmation or inform you electronically that we confirm that we have received your complaint. In addition, we will notify you of the number under which your complaint is registered in the records of received complaints.

We will respond to the complaint in writing or electronically no later than eight days from the day of receipt of the complaint. The answer will contain a decision on whether we accept the criticism, a statement on your request, and a specific proposal and deadline for resolving the complaint, which may not be longer than 15 days from the date of submission. We are obliged to act by the decision, proposal, and deadline for resolving the complaint if we have received your prior consent.

If for objective reasons, we are not able to satisfy your request within the agreed time, we are obliged to inform you about the extension of the deadline for resolving the complaint and specify the deadline within which we will resolve it, as well as obtain your consent, which we are obliged to record. in the records of received complaints. Extension of the deadline for resolving the complaint is possible only once.
